RULES AND REGULATIONS
REAL FANTASY GOLF.
- Participants must have a CONGU handicap and be a member of a UK Golf Course with a Standard Scratch Score.
- All paying participants must be over 18 years old, unless part of the FREE Real fantasy Golf Junior League.
- All winners scores will be corroborated with their club.
- Any participants found to be entering false scores or cheating during their round will be suspended from all competitions
- All merchandise prizes will not be offered as a cash alternative
- Participants MUST enter their scores before the cut off date each week otherwise the scoring zone will be closed and members will be unable to enter their scores. The week will then be classed as a no return. This does not disqualify you from the rest of the competition, as the final standings count 12 from 15 scores, over a 30 week period.
- Participants are only allowed to enter 2 scores per month for league scoring, once these 2 scores have been entered league scoring will be closed for the month and therefore any better scores than those already submitted will not be eligible
- All applications to participate in Real Fantasy Golf must be made either through the golf course that the applicant is a member of or online at Real Fantasy Golf
- The Race to Spain competition is one single competition, which carries no actual prize. The best placed 10 finishers will be invited to the end of season finals in Spain and will have their expenses paid (flight, hotel and green fees). The winner of the Spain Finals will receive a prize value totaling less than £500 (not cash) to comply with Royal and Ancient regulations on Amateur Status.
- The competition is run from servers hosted in the United Kingdom.
- Participants will need a valid e-mail address in order to register.
- Participants must be at least 12 years of age. Participants under 18 years of age must seek parental permission before applying and participating in the Game and adhering to the Rules and Regulations.
- Each Participant may only enter the league once. There is no limit to the number of applications per household, organisation or computer provided that each individual application is entered and maintained by a different person, with a different user name.
- Game details and rules for the Game can be found at the Website and are deemed to be incorporated into these Rules and Regulations. If there is any inconsistency or ambiguity between the rules and these Rules and Regulations, these Rules and Regulations shall prevail. Please see Rules for entry deadlines.
- RFG are not responsible for applications, information or results lost or delayed in the course of transmission for any reason whatsoever.
- In the event of a tie in any of the prize categories, winners will be the participant with (in the following order) the most NET (i) albatrosses, (ii) eagles, (iii) birdies (iv) pars
- RFG decision in all prize matters and all matters relating to the Rules of the game shall be final.
- Winners will be notified by electronic mail or in writing. Entry constitutes an irrevocable permission for RFG to use the names and photographs of participants at its discretion, for publicity purposes. Minors who win a prize must obtain written consent signed by their parent or guardian to such publicity being used by RFG in a form provided by RFG; failure to provide such consent will result in the prize being forfeit. No prizes will be offered to any members under 18 years old
- The Blog feature and other social networking facilities of the Fore!Sight website contains comments from individuals whose views and opinions expressed, represent their own and not those of RFG or of the people, institutions or organizations that the participant may or may not be related to, unless stated explicitly. Blogs may include links to websites operated by third parties. Third Party links are provided as a means of convenient access to the information/opinion contained therein. RFG is in no way responsible for the content of any blog or Third Party site or any content, products or services that may be offered through third party sites. Blogs that are found to contain material which RFG feels is inappropriate may be removed at RFG sole discretion.
- Employees of RFG, and anyone directly associated with the RFG, are not eligible to win any prizes.
- RFG is willing to investigate any complaints as it endeavours to ensure that its high standards are maintained. However, our decision is final and binding and we shall not be obliged to enter into any correspondence.
- RFG reserves the right to refuse participation, if in our sole opinion, the application does not comply with the rules and regulations.
- RFG has absolute discretion to disqualify any entry; to amend or waive these Rules and Regulations (including the rules) at any time in the event of circumstances arising beyond its control or which make it desirable to do so and the applicant agrees that no liability shall attach to RFG as a result thereof.
- RFG reserves the right to cancel this competition at any stage if deemed necessary in its opinion or if circumstances arise outside of its control.
- RFG will initially limit membership to 1500, but reserves the right to increase membership numbers if demand necessitates. However, all prizes and relating qualifying positions will be increased proportionally therefore retaining the published chances of winning.
- Data Protection: By submitting an entry, entrants agree that RFG and its authorised agents may collect and process personal information about them. For the purposes of the Data Protection, Data Protection Act 1998 is the "data controller" for the competition.
- Disclaimer: RFG cannot be held liable for any changes to match fixture dates, competition cancellations or any other matters or circumstances outside of its control. The RFG scoring system allows for enough leeway for participants to provide the requisite 12 scoring rounds.
- Whilst RFG will endeavour to ensure accuracy of information relating to the scores on the Website it does not guarantee the same and shall not be liable in the event of any inaccuracy.
- These Rules and Regulations will be governed by the laws of England and Wales and the parties irrevocably agree to submit to the exclusive jurisdiction of the English Courts.
- These Rules and Regulations only apply to the RFG 2009 game. Other RFG promotions will be subject to separate Rules and Regulations unless stated otherwise; to the extent that such separate Rules and Regulations may incorporate these Rules and Regulations in whole or in part, these Rules and Regulations shall take precedence in the event of any conflict or inconsistency between the two.
- The RFG name, league, logo, artwork, rules, scoring and any other intellectual property relating to the league and Website are all owned by RFG. Membership in the Service is void where prohibited. This Site is intended solely for users who are thirteen (13) years of age or older, and users of the Site under 18 who are currently in secondary school or college. Any registration by, use of or access to the Site by anyone under 13, or by anyone who is under 18 and not in high school or college, is unauthorised, unlicenced and in violation of these Terms of Use. By using the Service or the Site, you represent and warrant that you are 13 or older and in high school or college, or else that you are 18 or older, and that you agree to and to abide by all of the Rules and Regulations of this Agreement.
Registration Data; Account Security
In consideration of your use of the Site, you agree to (a) provide accurate, current and complete information about you as may be prompted by any registration forms on the Site ("Registration Data"); (b) maintain the security of your password and identification; (c) maintain and promptly update the Registration Data, and any other information you provide to Company, to keep it accurate, current and complete; and (d) be fully responsible for all use of your account and for any actions that take place using your account.
Proprietary Rights in Site Content; Limited Licence
All content on the Site and available through the Service, including designs, text, graphics, pictures, video, information, applications, software, music, sound and other files, and their selection and arrangement (the "Site Content"), are the proprietary property of the Company, its users or its licensers with all rights reserved. No Site Content may be modified, copied, distributed, framed, reproduced, republished, downloaded, scraped, displayed, posted, transmitted or sold in any form or by any means, in whole or in part, without the Company's prior written permission, except that the foregoing does not apply to your own User Content (as defined below) that you legally post on the Site. Provided that you are eligible for use of the Site, you are granted a limited licence to access and use the Site and the Site Content and to download or print a copy of any portion of the Site Content to which you have properly gained access solely for your personal, non-commercial use, provided that you keep all copyright or other proprietary notices intact. Except for your own User Content, you may not upload or republish Site Content on any Internet, Intranet or Extranet site or incorporate the information in any other database or compilation, and any other use of the Site Content is strictly prohibited. Such licence is subject to these Terms of Use and does not permit use of any data mining, robots, scraping or similar data gathering or extraction methods. Any use of the Site or the Site Content other than as specifically authorised herein, without the prior written permission of Company, is strictly prohibited and will terminate the licence granted herein. Such unauthorised use may also violate applicable laws including copyright and trademark laws and applicable communications regulations and statutes. Unless explicitly stated herein, nothing in these Terms of Use shall be construed as conferring any licence to intellectual property rights, whether by estoppel, implication or otherwise. This license is revocable at any time without notice and with or without cause.
Trademarks
FORE!SIGHT and other Company graphics, logos, designs, page headers, button icons, scripts and service names are registered trademarks, trademarks or trade dress of Company in the UK and/or other countries. Company's trademarks and trade dress may not be used, including as part of trademarks and/or as part of domain names, in connection with any product or service in any manner that is likely to cause confusion and may not be copied, imitated, or used, in whole or in part, without the prior written permission of the Company.
User Conduct
You understand that except for advertising programs offered by us on the Site, the Service and the Site are available for your personal, non-commercial use only. You represent, warrant and agree that no materials of any kind submitted through your account or otherwise posted, transmitted, or shared by you on or through the Service will violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights; or contain libellous, defamatory or otherwise unlawful material.
In addition, you agree not to use the Service or the Site to:
- harvest or collect email addresses or other contact information of other users from the Service or the Site by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications.
- use the Service or the Site in any unlawful manner or in any other manner that could damage, disable, overburden or impair the Site;
- use automated scripts to collect information from or otherwise interact with the Service or the Site;
- upload, post, transmit, share, store or otherwise make available any content that we deem to be harmful, threatening, unlawful, defamatory, infringing, abusive, inflammatory, harassing, vulgar, obscene, fraudulent, invasive of privacy or publicity rights, hateful, or racially, ethnically or otherwise objectionable;
- upload, post, transmit, share, store or otherwise make available any videos other than those of a personal nature that: (i) are of you or your friends, (ii) are taken by you or your friends, or (iii) are original art or animation created by you or your friends;
- register for more than one User account, register for a User account on behalf of an individual other than yourself, or register for a User account on behalf of any group or entity;
- impersonate any person or entity, or falsely state or otherwise misrepresent yourself, your age or your affiliation with any person or entity;
- upload, post, transmit, share or otherwise make available any unsolicited or unauthorised advertising, solicitations, promotional materials, "junk mail", "spam", "chain letters", "pyramid schemes", or any other form of solicitation;
- upload, post, transmit, share, store or otherwise make publicly available on the Site any private information of any third party, including, addresses, phone numbers, email addresses, Social Security numbers and credit card numbers;
- solicit personal information from anyone under 18 or solicit passwords or personally identifying information for commercial or unlawful purposes;
- upload, post, transmit, share or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
- intimidate or harass another;
- upload, post, transmit, share, store or otherwise make available content that would constitute, encourage or provide instructions for a criminal offence, violate the rights of any party, or that would otherwise create liability or violate any local, state, national or international law;
- use or attempt to use another's account, service or system without authorisation from the Company, or create a false identity on the Service or the Site.
- upload, post, transmit, share, store or otherwise make available content that, in the sole judgment of Company, is objectionable or which restricts or inhibits any other person from using or enjoying the Site, or which may expose Company or its users to any harm or liability of any type.
- Without limiting any of the foregoing, you also agree to abide by our Fore!Sight Code of Conduct that provides further information regarding the authorised conduct of users on Fore!Sight.
User Content Posted on the Site
You are solely responsible for the photos, profiles (including your name, image, and likeness), messages, notes, text, information, music, video, advertisements, listings, and other content that you upload, publish or display (hereinafter, "post") on or through the Service or the Site, or transmit to or share with other users (collectively the "User Content"). You may not post, transmit, or share User Content on the Site or Service that you did not create or that you do not have permission to post. You understand and agree that the Company may, but is not obligated to, review the Site and may delete or remove (without notice) any Site Content or User Content in its sole discretion, for any reason or no reason, including User Content that in the sole judgment of the Company violates this Agreement or the Fore!Sight Code of Conduct, or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of users or others. You are solely responsible at your sole cost and expense for creating backup copies and replacing any User Content you post or store on the Site or provide to the Company.
When you post User Content to the Site, you authorise and direct us to make such copies thereof as we deem necessary in order to facilitate the posting and storage of the User Content on the Site. By posting User Content to any part of the Site, you automatically grant, and you represent and warrant that you have the right to grant, to the Company an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide licence (with the right to sublicence) to use, copy, publicly perform, publicly display, reformat, translate, excerpt (in whole or in part) and distribute such User Content for any purpose, commercial, advertising, or otherwise, on or in connection with the Site or the promotion thereof, to prepare derivative works of, or incorporate into other works, such User Content, and to grant and authorise sublicences of the foregoing. You may remove your User Content from the Site at any time. If you choose to remove your User Content, the licence granted above will automatically expire, however you acknowledge that the Company may retain archived copies of your User Content. Fore!Sight does not assert any ownership over your User Content; rather, as between us and you, subject to the rights granted to us in these Terms, you retain full ownership of all of your User Content and any intellectual property rights or other proprietary rights associated with your User Content
